Terms and conditions of use of ATHENA membership, courses and services

Please read the following terms and conditions which relate to information regarding use of our website, and applying for ATHENA membership, courses and services. By using this website and applying for ATHENA membership, courses and services you are agreeing to these terms and conditions. From time to time we may change these terms and conditions and will post the revisions on our website www.nimdta.gov.uk. We recommend therefore that you read these terms and conditions regularly.

1. Access

1.1 General

The General Practice section of this website is designed for General Practitioners ("GP") who are registered with the General Medical Council ("GMC") and practising medicine in the UK. It is also designed for practice nurses and practice managers who work in primary care. Access to our General Practice section of our website and applying for ATHENA membership, courses and services are subject to certain access controls. Payment of a subscription for ATHENA Membership will be required in order to access restricted parts. All users require registration. We cannot guarantee that this website will always be available, nor that your access will not be uninterrupted or that transmissions are error-free.

1.2 ATHENA Members

ATHENA membership is non-transferable and non-refundable. ATHENA members all have as a membership benefit free access to most ATHENA courses and services during their membership period from 1st September 2007 to 30th June 2008 or for as long as NIMDTA agree. There may be some ATHENA courses or services that ATHENA members will have to pay an additional amount of money to attend, this may be due to the high cost or materials involved. ATHENA members will need to enter their ATHENA membership number and certain details to obtain access to restricted parts of ATHENA courses and services.
Most ATHENA courses and services have a limited number of delegate places. A reserve list will be made if a course is over-subscribed. ATHENA members will not be entitled to any refund if they apply for an ATHENA course / service that are oversubscribed and unable to obtain a place. Some courses / services may be solely available to ATHENA members. There is no limit to the amount of courses / services ATHENA members can apply for. ATHENA members must apply for all courses / services they wish to attend, and inform NIMDTA immediately if they wish to cancel any place (normally 7 days notice should be given).
ATHENA Members who fail to attend a course on two or more occasions, without adequate notice (normally 7 days) will be asked to pay a cancellation fee of £50 per course / service. Special consideration will be given where cancellation at short notice is due to an unforeseeable emergency - please email athena@nimdta.gov.uk. Failure to comply with this may invalidate ATHENA membership.

ATHENA Membership Costs
£135 Early Bird (Join between 1 September 2008 - 30 September 2008)  £150 (After 30 September 2008). 

Practice Membership Costs 

Practice Memberhsip - 20% reduction if 2 or more GP’’s in the practice joins.  ATHENA membership will also be given for all other practice staff at no extra cost.  £50.00 (Half Day Course for NON ATHENA member).  £75.00 (Full Day Course for NON ATHENA member).  Any amount of money paid for ATHENA courses / services prior to joining ATHENA will not be deducted from the ATHENA membership cost at that time.

Higher Professional Education GPs[1] are eligible to join ATHENA free of charge for 1 year, after which full ATHENA membership fees apply.

In the event of NIMDTA cancelling an ATHENA course or service we will give you immediate notice, as soon as we are aware of the situation. We will endeavour to contact you with all available and reasonable means. It is your responsibility to keep our records up to date with your contact information. If we are unable to contact you, because of out of date records and you attend the cancelled course, we are not responsible for any amount of money charged to yourself e.g. locum cover, childcare and mileage. ATHENA members are not entitled to any refund in the event of a cancelled course.
When you apply for ATHENA membership and courses / services on our website you will receive an auto-generated email confirming your order and instructing you to forward payment. You will receive a second email from us acknowledging your payment has been received. You should check all your emails for accuracy and let us know immediately if there are any errors. Please ensure your email address and contact details are up to date with us, we cannot be held responsible for any emails bouncing back (undelivered), or being unable to contact you.
Use of the website shall be subject to these terms and conditions.


1.3 Non ATHENA Members

Non ATHENA members will have to purchase access to the restricted parts of ATHENA courses and services. Some courses / services may not be available to NON ATHENA members. The price that you will pay for access to ATHENA courses / services should be the NON ATHENA standard prices indicated on our website. You will be charged in Pounds Sterling.
In the event of NIMDTA cancelling an ATHENA course or service we will give you immediate notice, as soon as we are aware of the situation. We will endeavour to contact you with all available and reasonable means. It is your responsibility to keep our records up to date with your contact information.  If we are unable to contact you, because of out of date records and you attend the cancelled course, we are not responsible for any amount of money charged to yourself e.g. locum cover, childcare and mileage.   NON ATHENA members will be entitled to a full refund in the event of a cancelled course.
NON ATHENA members who cancel a place on an ATHENA course / service more than or equal to 7 working days prior to a course / service date will be eligible to a full refund. NON ATHENA members who cancel a place on an ATHENA course / service less than 7 working days prior to a course / service date will be eligible to 90% refund of the course / service fee paid. NON ATHENA members who fail to attend a course / service they had applied and paid for without any prior notification will not be eligible to any refund (and if applicable an invoice will be raised to re-coup attendance costs).
Whilst we try to ensure that all the prices on our website are accurate, errors may occur. If we discover that there is an error in the prices, we will inform you as soon as possible and give you the option of recommencing your order at the correct price or cancelling it. If you do not respond to our contact, we will treat the contract as cancelled. If you cancel in these circumstances and we have already processed your payment, you will receive a full refund.
Payments may be made through the methods specified. We take all reasonable precautions to keep the details of your order and payment secure and therefore unless we are negligent, we cannot be held liable for losses caused as a result of unauthorised access to information provided by you.
When making a request to do an online payment, the language you will be offered for the conclusion of the process will be in English only.
When submitting your request to purchase or gain access to ATHENA membership, courses and services, you will be asked a series of questions and then you will proceed to a screen that will set out the total price. You will then proceed to our payment section and when you submit your payment details, you are making an offer to licence use of ATHENA courses and services, which we may accept or decline. After you have received your offer you will receive confirmation that either the payment was successful or unsuccessful.
When you apply for ATHENA courses / services on our website you will receive an auto-generated email confirming your order and instructing you to forward payment. We may allow you to have temporary access to restricted parts of ATHENA courses / services straight after a payment has been made however, this is a gesture of goodwill and does not represent acceptance of your offer. Irrespective of payment, our contract will not become binding until five working days have elapsed from a successful payment and only if we do not contact you. This is in case any price errors have occurred which will be treated as indicated above.
NIMDTA reserves the right to have full editorial control over ATHENA courses and services and may make changes to the website during the subscription period.
Use of this website shall be subject to these terms and conditions.

2. Accounts and passwords

When you enter these details which are registered with us, your right of access is personal to you, for as long as we choose to allow such access (where free) or as set out above. Personal accounts may not be shared, and you are responsible for preventing unauthorised access to your account. You accept responsibility for all activities that occur under your account or password.

3. Intellectual property rights

The content, layout, design, data, and graphics on this website are protected by UK and other international copyright laws. You agree not to adapt, alter or create any derivative work from any of the material contained in the website or to use the material for any purpose other than your personal, non-commercial use. None of the content of this website may be copied or otherwise incorporated into or saved in any other website, electronic retrieval system, publication, or any other work in any form (whether hard copy, electronic, or other), other than a Personal Development Plan, which you may download and store for your personal non-commercial use. For the avoidance of doubt, framing of this site or any part of it is not permitted without our express written permission.
For the avoidance of doubt, all template documents and software you use to create any Personal Development Plan on this website is our property, and you are granted a revocable, non-transferable licence for personal, non-commercial use.

4. Permission for use of our intellectual property

Any requests for permission of our images or other use of our intellectual property not authorised by these terms and conditions should be made to athena@nimdta.gov.uk.

5. Online learning module

Where you leave any response on any Online Learning Module, you grant us a non-revocable worldwide, royalty-free, transferable licence for use of that response on www.nimdta.gov.uk, and for which we may create derivatives of, distribute and display in any media. We may remove or edit your response at any time. Posting such a response is allowed strictly on the basis that the content is accurate, is not illegal, obscene, racist, abusive, threatening, defamatory, invasive of privacy, infringing any intellectual property rights, or otherwise injurious to third parties, or objectionable, and does not contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailing, or any form of "spam." You may not use a false name or email address to impersonate any person or entity whilst on any part of the Website or otherwise mislead the origin of your content. You agree to indemnify us for breach of these warranties.

6. Forum

Use of the ATHENA forum shall also be subject to the Forums Terms and Conditions. This service will be available soon.

7. Trademarks

The NIMDTA trademarks and logos that are displayed on this Website are the trademarks of the NIMDTA.  Any use of NIMDTA trademarks or other trademarks displayed on this Website is strictly prohibited without our expressed written consent.

8. Personal data and privacy

Use of the data you provide to us or which is collected by use of this website, is governed by our Privacy Policy.

9. Links

This website contains links including hyperlinks which may take you outside www.nimdta.gov.uk.   Links are provided for your convenience, and inclusion of any link does not imply endorsement or approval by us of the linked website, its operator or its contents, and we are not responsible for the content of any other website.

10. Losses

We will not be liable for any direct or indirect or consequential losses (including loss of profit, revenue, anticipated savings, data, goodwill or wasted expenditure) other than when your subscription cannot be fulfilled, following conclusion of a binding contract and in which case NIMDTA shall be liable only for the fees paid for the subscription. We do not however exclude or limit our liability for death or personal injury caused from our negligence or misrepresentation or any other liability that may not be excluded by law.

11. Events Beyond Our Reasonable Control

To the fullest extent permitted by law we will not be held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any causes which is beyond our reasonable control including reasons of Force Majeure which shall include any default due to an act of God, war, threatened war, act of terrorism or threatened terrorism, lock out, individual action, fire, flood, drought, tempest or other event beyond our reasonable control. This provision does not affect your statutory rights.

12. Alternation of Service or Amendments to Conditions

We reserve the right to make changes to our website, policies and terms and conditions at any time. You shall be subject to the policy’’s terms and conditions in force at the time that you use the website and apply for ATHENA membership, courses and services. If any of these conditions are deemed invalid, void or unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any other condition.

13. Disclaimer

This General Practice section of the website and all information contained on it, are provided on an "as is" basis and is intended for medical professionals. It is provided without warranty of any kind, express or implied.
We rely on our authors to confirm the accuracy of the information presented and therefore we as the publisher, and our editors, cannot warrant its accuracy. Readers / Users should be aware that professionals in the field may have different opinions. Because of this fact and also because of regular advances in medical research, we strongly recommend that readers / users independently verify facts. 16. Governing Law and Jurisdiction

To the fullest extent permitted by law, these conditions shall be governed by and construed in accordance with the laws of Northern Ireland, England and Wales. You agree, as do we do, to submit to the exclusive jurisdiction of the Northern Ireland and English Courts, save where it is necessary for enforcement proceedings to bring proceedings against you outside of England and Northern Ireland.
